Tatcha alleges that the packaging that Too Faced has designed for its new Peach Kiss Moisture Matte Long Wear Lipstick lipstick “confuses customers” for how similar they are.
"Too Faced has added a gold line and logo medallion on the cap, and significantly adjusted the dimensions and location of the markings on the tube to resemble Tatcha's signature packaging."
Tatcha's complaint demands that the launch of those new lipsticks be prevented and ensures that already, even before being on sale, they are causing confusion in the industry and for this they cite some comments from users of social networks, such as Instagram, who have noticed the similarity.
“The lipstick packaging looks a lot like Tatcha's. I don't like this”, says one user, while others assure that the demand was seen to come.
The plaintiffs claim in their claim that they have been using the same design since 2015 and the launch of this new Too Faced design is scheduled for August 31.
