Last January, similar questions were raised as to whether the appointment of Kushner's position in the White House violated federal nepotism laws, reported The New York Times. The Justice Department released memo stating that the rules did not apply to the White House.

In becoming a federal employee, Ivanka Trump said that throughout this process she has been working with the White House counsel and her personal counsel to address the “unprecedented nature” of her new role as a member of the President's family.

Ivanka stepped down from her fashion brands in January and transferred her brand assets into a trust overseen by her brother-in-law, Josh Kushner, and sister-in-law, Nicole Meyer, as reported by The Times.
