Gutierrez dismissed the lawsuit because the artist's legal team "did not adequately allege that the relationship with the Defendant was covered by the statute [of limitations]." The judge concluded that the change in the law code cannot be applied retroactively. However, the judge allowed the libel suit, where Judd alleges that the producer affected his career after denying his alleged sexual advances during the 1990s, to continue.

For her part, the actress's lawyer, Theodore Boutrous, was optimistic about the future outcome of the rest of the case.

“Nothing in today's [yesterday's] solution changes the fact that Ms. Judd's case continues in several accusations. Although we respectfully disagree with the Court's decision on today's decision, we will continue with the [other] three accusations,”said the lawyer.
