A mother who accidentally suffocated her newborn baby while sleeping in bed with him is suing the Portland Adventist Medical Center hospital and a nurse at the institution for "predictable harm" to her son, Jacob Daniel Thompson. Thompson also alleges that she has suffered from "negligent imposition of emotional distress" caused by the death of her baby. The newborn was only 10 days old when he died on August 12, 2012.

Jacob was a miracle baby. My first and only child. I am sharing this story in the hope that no mother or family will ever have to suffer through an avoidable tragedy like this, the mother said in a statement sent to CNN.

What establishes the demand? On August 5, the baby was taken to the nursery so that Thompson could rest. They had given him narcotics for pain and pills to rest. In the early morning hours of August 6, at 3:00 am, a nurse took the baby to the mother's room to breastfeed. The lawsuit explains that the nurse "left the room and left the mother and child alone."

The documents state that when the mother wakes up an hour later, she was sleepy and dizzy. Then, Thompson noticed that her son was not responding, the documents explain. Faced with the boy's lack of reaction, Thompson went out into the hall to seek help.

Family lawyer Diego Conde told CNN that there was no point in a hospital giving a mother narcotics and sleeping pills, bringing an infant to breastfeed, and leaving them to fend for themselves.
