Daniela Vargas, a young host to the DACA program and who made headlines this week when she was arrested after a press conference where she spoke about the deportation of her father and brother, she will be deported to her country without the right to a hearing.

This was stated by the lawyer for the 22-year-old Dreamer Abby Patterson. Vargas was arrested on Wednesday moments after the press conference where she denounced the raid on February 15 in which her father was apprehended. Daniel Vargas, and his brother, Alan Vargas, to be deported to his native Argentina.

Vargas was arrested while riding with a friend in a car, despite being covered under the Deferred Action for Childhood Arrivals (DACA) program, which had expired and was awaiting renewal.

The lawyer told the Jackson Free Press newspaper that Daniela will not be granted bail or a court hearing because her family entered the country through a visa exemption program, which allows immigrants from certain countries to enter the country for a period up to 90 days without a visa.

The lawyer explained that according to said law, the beneficiaries of this program cannot review or appeal any deportation action unless they request asylum based on verifiable fear.

"[The immigration agents] have no plans to give her a hearing in front of an immigration judge and she will be prepared to be deported, so they will prepare her travel documents and a flight plan," Patterson told the newspaper.

"Every day, as part of routine operations, the Immigration and Customs Enforcement (ICE) with its fugitive [capture] operations arrests foreign criminals and other individuals who violate immigration laws ICE for its part said in a statement. "Such operations," it was said, "are conducted in accordance with federal law and the agency's policies. ICE does not conduct searches or raids in which foreigners are randomly targeted.”
