While speaking in a language other than English in the United States is obviously not a crime, two U. S. citizens had a rough time recently when a Border Patrol agent overheard them speaking Spanish at a Montana store and held them on suspicion that they were undocumented.

Ana Suda and Mimi Hernández, who also have Mexican nationality, were making some purchases near midnight last Wednesday in the town of Havre when when they went to pay, a uniformed officer withheld them and asked for their identity documents, according to the New York Post.

The women asked the officer, who identified himself as Border Patrol agent O'Neal, why he had detained them and asked for the papers. "Madam, the reason I asked for your identification is because you were speaking in Spanish, which is not very common in the area," argued the uniformed man, according to the video of the moment recorded by one of the women.

The agent's action has sparked all kinds of comments and criticism after the women shared a video of the incident on social networks in order to report a treatment that they found discriminatory.

Despite the fact that the agent is very respectful at all times, for Ana and Mimi the situation turned almost into a 40-minute nightmare. "We feel ashamed … as if we had done something wrong … my friend would not stop crying in the truck," Suda revealed in conversation with a local outlet.

A spokesman for the United States Office of Customs and Border Protection assured the Washington Post that Border Patrol agents have the authority to question any individual if they deem it necessary.
