After several attempts by Kate del Castillo to gain access to the investigation carried out by the Attorney General of the Republic (PGR) in Mexico, after her meeting with Joaquín el Chapo Guzmán; a federal court gave the final decision that prevents the actress from accessing said information, according to the Mexican newspaper Reforma.
"In any case [he may review the investigation] when he voluntarily appears before the investigating Public Ministry agent and renders his initial statement on the date and time that he is summoned," specifies the document under review 82/2017.
The current condition of the protagonist of La ingobernable is as indicated, that is, she is the subject of a series of investigations for alleged cover-up and money laundering; it is not simply a witness. Therefore, the First Collegiate Court considers that they are acting legally in this case, without violating their rights.
"The refusal to grant him the access requested through his attorney does not violate the human rights of the complainant, as long as he fails to appear before the agent of the Public Ministry," the legal documents explain.
Judges Francisco Javier Sarabia Ascencio, rapporteur of the case, as well as Horacio Hernández Orozco and Miguel Sánchez Frías, unanimously confirmed the initial ruling of federal judge Augusto Octavio Mejía, who had denied the protection of the actress.
Given this legal decision, Kate del Castillo, who made the initial request to access her file since January 2016, is unable to review the documents of the process to which she has been submitted by the Mexican authorities.
