A Utah woman faces criminal charges after her stepchildren discovered her bare-breasted when she was undressing at home with her husband, something authorities consider to be a lewd act and she is evidence of discrimination against women.

Tilli Buchanan, 27, appeared in court last Tuesday with her lawyer to defend herself against the charges, arguing that the laws under which she has been charged are unconstitutional for discriminating against women, according to local media.

According to the Salt Lake Tribune newspaper, Buchanan and her husband had been working in the garage of their home when they decided to take off their clothes to shower. While they were undressing, her husband's children, aged 13, 10 and 9 at the time, came down and saw them both bare-chested.

As the little boys were embarrassed, Buchanan explained that a woman's breasts are not necessarily a sexual organ, so seeing a woman's naked torso should be no different than seeing a man's.

"This is not a sexual thing," said the stepmother, according to the newspaper. “It should be exactly the same as in my husband's case. You should not be embarrassed by this."

But prosecutors do not consider the episode to be innocent and educational in purpose. According to her version of events, the accused was under the influence of alcohol and said that she would not cover her chest until her husband showed his genitals, according to the newspaper.

This is not the only discrepancy: the authorities maintain that these events occurred in the fall of 2016, but defense attorneys assure that it occurred between November 2017 and January 2018.

In any case, Buchanan maintains that they did not give importance to what happened until she was charged last February after an investigation by the state department of Children's Services.

“I am devastated because at that time I took it as a lesson for the children and [later] we forgot. You can no longer educate children, "he told the newspaper.

If found guilty, Buchanan could face a prison sentence and would have to register as a sex offender for the next 10 years.

“It was in the privacy of my home. My husband was by my side, in the same way that I was, and he is not being prosecuted,”she complained to CBS.

Her lawyer, Randy Richards, considered it disproportionate that in the event of a guilty verdict, her client be classified as a sex offender, just like a rapist.

The judge will announce his ruling within two months.
