Wesley Mathews, the father of a 3-year-old girl who was found dead after being punished for not drinking milk, could face the death penalty, authorities in Dallas, Texas have said.

The 37-year-old man was arrested in October following the discovery of the lifeless body of his foster daughter, Sherin Mathews. The girl had been seen for the last time when, according to the father, he punished her for not drinking milk. The punishment was for her to stand in the backyard of her house, which faces an alley.

Subsequently, the girl - who was born in India and who suffered from her developmental abilities with limited verbal skills - was found in a local drain.

"We will be tenacious, we will be persistent and we will pursue this case to its ultimate consequences," Dallas District Attorney Faith Johnson said at a news conference.

According to a statement obtained by People, Mathews is accused of injuring a minor, abandoning a minor and concealing evidence of a crime, charges that could carry the death penalty. For its part, the prosecutor noted that it has yet to decide whether or not to seek such punishment for the accused.

The subject confessed that on October 7, while at his home, he punished little Sherin for not wanting to drink milk. The man explained that he took the girl out of the house and made her stand by a tree. So he and his wife went to dinner with their biological daughter - also 3 years old - leaving the girl alone.

Later, when the girl was located, Wesley changed his version to confess that he had forced the girl to drink. According to what he said, the girl was drinking her milk in the garage of the house and that he wanted to "help her" because "he was not paying attention to her."
