Court documents indicate that the incident occurred around 12:30 p.m., when the three men showed up at a 31-year-old man's apartment and knocked on his door. The two youngest had masks covering their faces.

After forcing their entry, the subjects beat and kicked their victim and a 51-year-old man who was in their home. Amid these assaults, their youngest victim insulted them with an epithet used in prisons to name prisoners who rape others in jail. This infuriated White who proceeded to rape him with a metal tube, while his two companions held him down.

After the rape, Ramos poured gasoline on his two assailants, but later they did not set them on fire because Dunnican persuaded them not to. It was then that another 41-year-old man suddenly appeared in the house who, trying to fight with the bandits, was shot twice in one of his legs.

The rogues fled the scene not without first stealing cell phones and even the shoes of their victims. However, police officers who were in the area arrested them. Upon searching, they found that White carried a firearm with him, Ramos carried 14 bags of marijuana in one of his pockets, and Dunnincan rolls of duct tape, a knife, and a stolen phone.
