The coronavirus pandemic has changed agendas and forced the cancellation of important social events, ruining the plans of thousands of couples who were planning to seal their love with elaborate family ceremonies.
But if this health crisis forced you to postpone your wedding - which in most cases can exceed the number Leah Weinberg, owner of Color Pop Events, told People.
These types of cancellations are severe cases attributed to weather, law changes, deaths, etc., according to Weinberg.
The coronavirus outbreak has triggered a series of contractual items for many events that would take place during the spring, but most of the cases are being handled individually. Some of the stores are only keeping the deposit without demanding the final payment for the services, while others offer a full refund.
For her part, attorney Caroline Fox recommends postponing the date, as some of the contracts will not be annulled simply because coronavirus is a cause of force majeure, so she recommends signing a contractual amendment between the parties to change the date. In this way, the affected couples could recover some of the charges and apply them for the new date.
In addition, reviewing the insurance policy for the event is also important, taking into account the work already done by the merchants.
"In a situation where [they offer] a product that requires labor, such as flowers, the florist may have already worked on the design and performed together," the lawyer explained. "Compare this to a transportation company that couldn't have done any" work "beyond the reservation process. A full return is more viable in that situation where no work has been done.”
However, the lawyer said that for the moment filing a lawsuit against sellers who refuse to return the money is the only option.
“If the couple feels that the terms [of the contract] are unclear, they should consult an attorney to determine their situation. And the same goes for sellers, "added Weinberg.
The pandemic and its consequences are a new topic, which is why both experts emphasize the importance of being flexible when exposing their situation.
"Couples can't indefinitely postpone [their wedding] and pretend to have vendors waiting for them," Weinberg said. "I am a faithful believer that open, honest and direct communication will resolve many of the conflicts that may arise."
