Relatives of a 91-year-old woman are suing a Chicago nursing home and two of her caregivers whom they accuse of molesting the elderly woman with senile dementia. The complaint arose after it was discovered that the defendants posted a Snapchat video on networks showing how the old woman was being shoved.

The events date back to December 2018 inside the clinic The Abington of Glenview Nursing & Rehab Center, where the alleged victim by the name Margaret Collins lived.

The video began circulating on the platform under the title "Margaret hates gowns" (Margaret hates nightgowns) and was accompanied by laughter emojis. The nurses Bryan Cortez, 20, and Jamie Montesa, 21, are seen there, shoving the woman's garment while she struggles to resist the abuse.

Someone alerted Joan Biebel, the old woman's daughter, to the existence of the video. Collins' family subsequently notified the nursing home of what was happening.

"They deliberately molested and tempted my mom," the woman exclaimed in pain in a statement released by NBC and CBS. "They did it for their own fun and they published it for their friends."

The most outrageous thing is that six days after the complaint was made before, and after a brief suspension, Cortez and Montesa were back at the institution. Official documents revealed that the allegations against the staff had been concluded "to be unfounded," the Illinois Department of Public Health (IDPH) decreed.

Given this resolution, the woman's family decided to remove her from the asylum and take her to live with the family under the supervision of a private caregiver.

Biebel assures that the video was like a betrayal for his mother. "I was heartbroken because she loved these guys," he said.

Glenview Police launched an investigation and last January filed charges against both nurses for disorderly conduct. They were both released on $ 75 bail, but they have a court date this month to review the case.

In this regard, Cortez has stated that they were only "playing" with the old woman and that she "responded back by playing", while Montesa assures that she sent the video to her colleagues but never published it on the networks. Both have admitted that they did wrong to record it, according to an IDPH report.

"This is elder abuse and they did nothing about it," says Steven Levin, the attorney who represents the family and is now seeking $ 1 million in damages. "What is really scary is that … I wonder how many other people have done this to," Biebel said.
