Juan Gaspar-Garcia, 22, a Guatemalan from Florida, was one of 28 people detained at Fort Pierce on March 28, when federal agents carried out a search warrant at a tent installation company. According to his relatives, Gaspar-García needs special care since he has Down syndrome.

The young man worked at TentLogix with his brother, whose name was not disclosed. Gaspar-García's brother was released because he is protected by the DACA Deferred Action for Childhood Arrivals (DACA) law, protection against deportation that is granted to certain undocumented youth.

According to his sister, if Juan is deported to Guatemala, he has no one to care for him since he was sent to the United States after his mother's death in 2007 in his native country.

"We are a family of four. Juan is the oldest, but we have always seen him as the youngest due to his mental retardation," Dolores said. "He doesn't really know how to read, write or express himself well and he stutters when he gets nervous. I'm sure he needs me right now."

According to the Nuevo Herald report, Rubio's office learned of the petition online Tuesday and will contact the family to offer any help.

At the moment, Juan Gaspar-García remains detained at the Broward Transition Center in Pompano Beach.
