A mother in New York accuses the father of her autistic son of killing the 8-year-old boy. The boy froze because his father forced him to sleep in his garage at home during the winter, according to reports. In July 2019, the mother, Justyna Zubko-Valva, pleaded with Judge Joseph Lorintz to return custody of her three children, the New York Daily News reports, citing court records. The mother claimed that the children were in danger at the home of their father, Michael Valva, an officer with the New York Police Department.

Five months later, her 8-year-old son Thomas Valva was found dead. "Everywhere I went I was surrounded by so much injustice and corruption on the part of the people involved in the case and the result was the death of Tommy," the mother told the New York Daily News. "There were so many people who could have done something to protect my children but they didn't."

The boy's father allegedly hit him on January 17 and forced him to sleep in the cold garage of his New York home. Michael Valva, 40, and his fiancé Angela Pollina, 42, were arrested and face murder charges. The mother testified before the judge that the father was beating the children and asked that they return their children to him, arguing that they had been illegally taken away from them. The judge denied his request. "Children's lives are in danger," said the mother. The judge was unmoved, the court transcript shows, and told him to "call the authorities."

The mother added that the children were being abused at their father's house and were returning to her house with urine. "Anthony is sleeping in the garage," said the mother. "They are not giving him food." The desperate mother assured the judge that the Department of Child Protection was not doing its job investigating the case. "Those judges are responsible for Tommy's death and for the enormous abuse that was going on for so long," the mother alleged. "Those judges acted like they didn't care."
