An appeals court in Ohio overturned the conviction of the former model who allegedly tried to hire a hitman to kill her husband's ex-wife. The woman will be released from prison today, her lawyer told People.

Tara Lambert, 34, will be released from the Ohio Reformatory for Women in Marysville, where she has been held since last year after the jury convicted her of first-degree felony charges of conspiracy to commit aggravated murder.

Attorney Sam Shamansky, who represented Lambert on his appeal, confirms to People that his client's sentence was overturned on Tuesday. Lambert had been sentenced to seven years of service.

The judge reversed Lambert's conviction after realizing an error made in the language of the prosecution. Due to this misstep, the case against Lambert should never have proceeded, the judge ruled.

According to the Columbus Dispatch newspaper, a conspiracy to commit aggravated murder charges requires prosecutors to declare a specific "manifest act" that Lambert had vowed to make this happen.

"Did you buy a gun, for example? The prosecutor had to explain exactly what was the underlying manifest act that contributed here, "Shamansky told the newspaper.

It was unclear Friday whether Pickaway County District Attorney Judy Wolford plans to appeal Tuesday's decision, as she could not be reached for comment. But Shamansky says he anticipates appeals of the decision and that the prosecution will move to impeach Lambert again.

Shamansky added that he filed a malpractice lawsuit against Kingsley on behalf of his client six weeks ago.

According to investigators, Lambert met with an undercover police officer posing as a contract killer and provided the police officer with a down payment and a photo of the mother of his stepchildren.

During her conversations with the undercover officer, she allegedly suggested using a wood chipper to dispose of the remains. Lambert's husband has two daughters with his ex-wife. The two were seeking custody of their daughters, records show.
